PL 200--Criminal Law
In class today, 1/26, we had our first quiz. We discussed chapter 2 through p. 41. For next Tuesday, review the remainder of chapter 2, and the read chapter 3 up through p. 67.
PL 302 Family Law
In class today, 1/26, we went over the Braschi case and brief. I went over some subsequent caselaw that discussed Braschi.
The assignment for Tuesday,1/31 is to read Chapter 3 of the text. Also read the Simeone case on p. 108. Also read the Maine Uniform Premarital Agreement Act at 19-A MRSA sections 601-611. Then write out your answer to this question:
If the facts of Simeone had happened in Maine under our statute,
1) what specific questions would we have to answer in order to determine if the Agreement would be enforceable here in Maine (what issues under the Maine statutory requirements arise under these facts) and
2) what specific facts from Simeone would bear on the questions you’ve identified.
The questions may deal with the definition of certain words, or may deal with the application of certain statutory requirements to the facts of the case. I’m not asking you to resolve (answer) the questions, only to pose them.
Use good English, in your own words (other than when you have have to use certain words or phrases from the statute).
